1.1 These Website Terms of Use ("Terms") govern the public-facing HeroSwipe landing pages and related informational pages that display or link to these Terms (the "Website"). The Website is operated by HEROSWIPE spółka z ograniczoną odpowiedzialnością, a limited liability company incorporated in Poland ("HeroSwipe", "we", "us" or "our").

1.2 "You" means a person using the Website, whether on their own behalf or on behalf of a business. These Terms cover the free Website services described below. They do not, by themselves, govern an operational HeroSwipe account, paid services, participation in tests or the redemption of rewards.
1.3 These Terms are available free of charge before you request a Website service. You may save or print them and request a copy by email.
2.1 Depending on the features available on the relevant page, the Website allows you to read information about HeroSwipe, submit an enquiry, request a demonstration, register interest in business services or the tester community, join an early-access waiting list, and subscribe to email updates.
2.2 These Website services are free. You remain responsible for charges imposed by your internet or telecommunications provider.
2.3 Actual use of A/B testing, Content Generator, marketplace integrations, subscriptions, tokens or credits, and the HeroTester programme requires the applicable service terms to be provided and accepted separately before that use begins. Any additional beta or pilot terms will also be identified before participation.
2.4 Accepting these Terms or submitting a Website form does not accept an unseen product agreement, authorise a payment, purchase a subscription, or automatically convert a free service into a paid service. Separate product terms govern their own subject matter and do not remove rights accrued under these Terms.
3.1 Our enquiry, demonstration and early-access sign-up features are intended for people aged 18 or over. If you act for a business, you must be authorised to submit the relevant request. Eligibility to participate in actual tests is determined separately under the HeroTester terms.
3.2 You need an internet-connected device and an up-to-date browser supporting secure HTTPS connections. Interactive features may require JavaScript. A working email address is required for email-based services. Non-essential cookies are not required to browse the Website or submit an ordinary enquiry.
3.3 Provide accurate information and use contact details you are entitled to use. Keep your device and browser updated. Online communications can involve risks such as phishing, malicious software and unauthorised access; report suspicious messages purporting to come from HeroSwipe to our contact email.
4.1 The free service of displaying Website information begins when a requested page is displayed and ends when you stop browsing. For an enquiry, demonstration request or waiting-list registration, the relevant free service agreement begins when your request is successfully submitted after these Terms have been made available to you and any required acceptance has been given. If the form requires email verification, registration is completed after that verification.
4.2 An enquiry or demonstration-request service ends when the request has been handled or you withdraw it. A waiting-list service continues until you withdraw, we send the requested invitation or notification, or the service is ended in accordance with these Terms.
4.3 Joining a waiting list records your interest. It does not itself activate an operational account, guarantee admission to a pilot, reserve testing work or guarantee a launch date. Access may depend on country availability, technical readiness, capacity and any eligibility criteria disclosed for the programme.
4.4 Before operational access begins, we will explain the applicable scope, limits, duration and service terms. We will not charge for that access unless you separately and expressly agree to the relevant price and payment terms. Any specific promotional commitment made to you remains subject to applicable law and will not be withdrawn merely by referring to this section.
5.1 We may send messages needed to handle a request you make, such as an enquiry response, verification message or the launch notification you specifically requested. Requesting one of these messages does not subscribe you to unrelated marketing.
5.2 General product news, promotional offers and marketing newsletters are sent only after you separately opt in. Your choice must be affirmative; marketing consent is not inferred from browsing, accepting these Terms or submitting an unrelated enquiry.
5.3 Where an email subscription is offered, it starts when your opt-in is registered and any requested email verification is completed. It continues until you unsubscribe or the subscription service is ended under these Terms.
5.4 You may withdraw marketing consent at any time, free of charge, using the unsubscribe facility in an email or by writing to [email protected]. Refusing or withdrawing marketing consent does not prevent you from browsing, contacting us or receiving a response to your request.
6.1 You may stop browsing at any time. You may withdraw an enquiry, leave a waiting list or end an email subscription at any time, without giving a reason or paying a fee, by using an available cancellation facility or contacting us. Cancellation takes effect when your request reaches us.
6.2 If you are a consumer, you may also withdraw from a free ongoing Website-service agreement within 14 days after it is concluded, without giving any reason. We offer this right even where it would not otherwise be required by law. Any longer or more favourable statutory right remains unaffected.
6.3 To withdraw from a Website-service agreement, send an unequivocal statement to [email protected], [email protected] or our correspondence address. Sending it before the applicable deadline is sufficient. You may use the optional consumer withdrawal form at the end of these Terms, but it is not compulsory. There is no charge for a free Website service supplied before withdrawal.
6.4 Ending a Website service does not automatically terminate a separate product agreement. It does not affect accrued rights, complaints or data-protection rights. Any lawful retention of records is explained in our Privacy Notice.
6.5 Instructions for deleting an operational HeroSwipe account are provided on our separate Account Deletion page. You may request deletion through the account-deletion option in the app or by emailing [email protected]. After any necessary verification, the account is deactivated for 7 days (168 hours), counted from deactivation, and then permanently deleted unless you cancel your request. We confirm the deactivation and exact deletion deadline by email. To cancel, email the same address before that deadline; a valid cancellation received in time stops deletion even if we confirm it later. These instructions do not replace the separate product terms governing account use, payments or rewards.
6.6 The account-recovery period in section 6.5 does not apply to cancellation of a Website service under section 6.1, consumer withdrawal or withdrawal of marketing consent. It does not restrict requests for erasure under applicable data-protection law or affect accrued claims. Limited lawful data retention is explained in the Privacy Notice and Account Deletion page.
7.1 HeroSwipe is developing services for comparing product images and other marketing materials using feedback from human testers, and for creating or improving marketing content with AI. Content may include product titles, descriptions, bullet points, enhanced product content, images and other materials, depending on the features expressly offered.
7.2 Features identified as planned, in development or coming soon are not yet available. Illustrative screens, example reports and demonstrative figures are not results for your particular product. Any delivery time, sample size or performance figure identified as an estimate is an estimate, not a guarantee.
7.3 Test results reflect the participating testers and the conditions of the particular study. They do not by themselves establish market-wide representativeness or guarantee sales, conversion rates, advertising performance or marketplace rankings.
7.4 AI-generated examples may contain errors, omissions, unsuitable claims or material similar to other content. Product facts, rights to images and other material, and applicable advertising and marketplace requirements require human review before publication. Website examples do not transfer ownership of intellectual property or guarantee exclusive or copyright-protected output.
7.5 General service descriptions invite enquiries and do not, by themselves, place an order. This section does not override agreed service specifications, legally binding promotional commitments or mandatory rights relating to pre-contractual information or misleading statements.
8.1 Registering interest in HeroTester is free and voluntary. Visiting the Website or joining a waiting list does not itself earn points, create a right to payment or guarantee access to a particular number of tests.
8.2 Before you participate in a rewarded activity, the applicable programme terms and activity information must explain the reward, eligibility and completion requirements. Depending on the programme actually offered in your country, rewards may take the form of money, points redeemable for specified rewards, vouchers or another expressly described benefit.
8.3 These Terms do not set reward rates, point values, conversion rules, redemption thresholds, expiry periods or payment schedules. These matters, including any verification and review procedures, belong in the separate HeroTester terms. Clearly labelled examples on a development page do not establish the final scheme or diminish rights arising from an actual offer.
9.1 You must not use the Website to provide unlawful content, infringe intellectual property or privacy rights, impersonate another person, submit fraudulent requests, send unsolicited advertising, distribute malicious code, obtain unauthorised access or interfere with the Website or other users.
9.2 Automated access must not circumvent access controls, compromise personal data or materially disrupt normal operation. Nothing in this section restricts activities that cannot lawfully be restricted.
9.3 You may report suspected abuse, unlawful material or a security issue to [email protected]. Do not include passwords or unnecessary personal information in your report.
10.1 To the extent protected by law, the Website design, software, text, graphics, logos and other materials belong to HeroSwipe or their respective rights holders. You may access them and make copies reasonably needed to evaluate our services, including for internal business purposes, or to retain these Terms.
10.2 Other use requires an appropriate permission or legal basis. You must not falsely imply that HeroSwipe endorses you or your business. Statutory exceptions and other non-waivable rights remain unaffected.
10.3 You retain rights in material you submit. You permit us to receive, store and use it only as reasonably necessary to handle your enquiry or provide the requested Website service, including through service providers acting for that purpose. These Terms do not grant us a general right to publish your material, use it in advertising or train AI models on it.
10.4 Ordinary Website forms are not intended for uploading product datasets, confidential business documents, passwords, payment credentials or sensitive personal information. Contact us first to agree an appropriate channel and, where needed, confidentiality arrangements. Rights in product uploads, test materials and generated outputs must be addressed in the separate product agreement.
11.1 The Website may link to third-party websites, app stores, social networks or marketplaces. Those services have their own terms and privacy information. A link or reference does not, by itself, imply affiliation, endorsement or a partnership.
11.2 References to marketplaces describe intended contexts or integrations. Unless expressly stated otherwise, consumer tests take place within HeroSwipe, not directly on the referenced marketplace. Availability of any actual integration is determined by the applicable product offering. This section does not exclude responsibility for our own conduct or representations.
12.1 HeroSwipe is the controller of personal data processed for its own Website administration, enquiry-handling and communication purposes. Our separate Privacy Notice explains the data collected, purposes, legal bases, recipients, retention periods, any international transfers and your rights, together with how to contact us or a supervisory authority.
12.2 Accepting these Terms is not blanket consent to personal-data processing, profiling, marketing or non-essential cookies. Where consent is required, it is requested separately and can be withdrawn.
12.3 Information about cookies and similar technologies is provided in our cookie information and, where applicable, the Website consent interface. Technologies requiring consent will not be activated before that consent is obtained. Strictly necessary technologies may be used as permitted by law. You may revisit and change your optional choices.
12.4 Data processing within the tester application, audience matching and business platform requires the relevant service-specific privacy information. These Terms do not replace that information.
13.1 We use reasonable care in operating the Website, but maintenance, technical faults or security incidents may interrupt access. We will take reasonable steps to address problems within our control.
13.2 We may restrict a particular use where reasonably necessary to address a credible security risk, unlawful conduct, a material breach of these Terms or a binding legal requirement. Restrictions will be proportionate in scope and duration. Where lawful and practicable, we will explain the reason and provide an opportunity to resolve the issue or request a review.
13.3 We may discontinue a free ongoing waiting-list or email-update service if the relevant programme ends or the service is withdrawn. We will normally give affected subscribers at least 30 days' notice by email; a shorter period will be used only where legally required or necessary to address an urgent security risk. Accrued rights remain unaffected.
14.1 Each party is responsible for its conduct in accordance with applicable law. These Terms do not exclude or limit liability where doing so would be unlawful, including liability for fraud, intentional misconduct or any other non-excludable liability.
14.2 Nothing in these Terms removes mandatory consumer remedies, data-protection rights, or rights arising from misleading information. The limitations inherent in research, AI examples and third-party services do not excuse a failure to fulfil an express contractual obligation.
14.3 Where Polish law extends specific consumer protections to a sole trader acting outside the professional character of their business, those protections are preserved to the extent applicable.
15.1 Send Website complaints to [email protected] or our correspondence address in section 1. Briefly describe the issue, when it occurred and the outcome you seek, and provide a way for us to respond. Screenshots may help, but do not include unnecessary personal or confidential information.
15.2 We will respond within 14 calendar days after receiving a complaint, unless applicable law requires a shorter period. We will send the response by email or another appropriate durable medium. Requests for additional information do not extend a mandatory response deadline.
15.3 Where Article 7a of the Polish Consumer Rights Act applies, failure to respond within the statutory period has the consequences prescribed by that provision, including deemed acceptance of the complaint. Any more favourable mandatory rule remains applicable.
15.4 This procedure does not prevent you from contacting a competent authority, obtaining consumer assistance, using an available alternative dispute-resolution procedure or bringing court proceedings. It is not a compulsory preliminary step before exercising statutory rights.
16.1 We may amend these Terms to reflect changes in law, the scope of free Website services, proportionate security measures or corrections that improve clarity. Amendments will be limited to what is reasonably connected with the stated reason.
16.2 For new requests, the version made available before the request applies. For an ongoing Website service, we will provide the revised Terms, the reason for the change and its effective date by email at least 30 days in advance, unless a shorter period is legally required or necessary to address an urgent security risk.
16.3 Changes do not apply retrospectively, remove accrued rights or introduce fees without separate express agreement. You may end a free ongoing service before a change takes effect. Where express acceptance is legally required, we will obtain it; silence will not replace it.
17.1 These Terms are governed by Polish law. If you are a consumer, this choice does not deprive you of mandatory protections under the law of your country of habitual residence where those protections apply.
17.2 Courts are determined by applicable jurisdiction rules. These Terms do not require a consumer to bring proceedings exclusively in Poland or waive a right to sue in another competent court.
17.3 Availability of the Website from another country does not itself mean that every HeroSwipe service is offered there. Country-specific eligibility, service conditions and mandatory local requirements must be addressed before the relevant service is supplied.
17.4 This version is in English. If we provide a translation, mandatory local-language and consumer-protection requirements prevail over any inconsistent interpretation. An invalid provision does not affect the remainder of these Terms where the remainder can lawfully continue to apply.

Use this form only to withdraw from a Website-service agreement. It is not an account-deletion form. For account deletion and the 7-day recovery period, see the separate Account Deletion page. You may send any other unequivocal withdrawal statement instead.
